Traffic Tickets for Florida Statute Section § 316.0895
Under Florida Statute Section § 316.0895(1), Fla. Stat., the driver of a motor vehicle may not follow another vehicle more closely than is reasonable and prudent under the circumstances. The driver must give due regard for the speed of other vehicles and for the traffic upon, and the condition of the highway.
Under § 316.0895(2), Fla. Stat., when traveling on a roadway outside of a business or residence district, the driver of any motor truck, a motor truck drawing another vehicle, or a vehicle towing another vehicle or trailer, may not follow within 300 feet of another motor truck.
Florida law does not prevent the driver from overtaking and passing. Likewise, under § 316.0895(2), Fla. Stat., the law does not apply upon any lane specially designated for use by motor trucks or other slow-moving vehicles.
Under § 316.0895(3), Fla. Stat., except when vehicles are being driven in funeral processions, a vehicles driven on any roadway outside of a business or residence district in a caravan or motorcade, whether or not towing other vehicles, must be so operated as to allow sufficient space between each vehicle so as to enable any other vehicle to enter and occupy such space without danger.
