Points for Speeding in a School Zone

Although the fines are doubled, the points assessed for speeding in a school zone are the same for other speeding tickets:

  • Unlawful speed – 15 MPH or less over lawful or posted speed  -  3
  • Unlawful speed – 16 MPH or more over lawful or posted speed  -  4
  • Unlawful speed resulting in a crash  -  6

An accumulation of these points on your driving record can lead to a suspension of your driving privileges for months. Violation of the speed limits established pursuant to Florida Statute 316.1895 must be cited as a moving violation, punishable as provided in chapter 318. Florida Statute 316.1895 (5) provides that a school zone speed limit may not be less than 15 miles per hour except by local regulation. Additionally, no school zone speed limit shall be more than 20 miles per hour in an urbanized area.

The school zone speed limit may only be in force only "during those times 30 minutes before, during, and 30 minutes after the periods of time when pupils are arriving at a regularly scheduled breakfast program or a regularly scheduled school session and leaving a regularly scheduled school session."

Signage in School Zones

Florida Statute 316.1895 (6) provides that permanent signs should be used to designating school zones. The school zone speed limits must be uniform in size and color. The signs must post the times during which the restrictive speed limit is enforced. That notice must be clearly designated on the sign. As an alternative to posting the times, the statute provides that "flashing beacons activated by a time clock, or other automatic device, or manually activated may be used...."
Additionally, a sign must be posted in the school zone that says “Speeding Fines Doubled.” The standards for the flashing beacons and signs are established by the Florida Department of Transportation. Additional rules apply to portable signs when used in the school zone. If proper signage is not displayed at a school in Ft. Lauderdale, an attorney may have grounds to fight for dismissal of your ticket.

Texting in a School Zone - Other types of traffic tickets come with extra points if the offense occurs in a school zone. For instance, a texting, while driving citations normally do not result in any points for a first offense. But two points are added if the primary offense if the texting offense occurred in a school zone. That means that two points are assessed for a first offense and five points are assessed for a second offense of texting if the texting occurred in a school zone.
