Pace Clock Speeding Enforcement

Pace Clock Tickets in South Florida

In many speeding ticket cases, the officer will estimate the speeding using a pace clock technique. Under this technique, the officer follows the motorist for a sufficient distance at the same speed and, using the speedometer on the police vehicle, estimates the speed of the motorist.

If you received a speeding ticket involving a pace clock in Palm Beach County, then call an experienced traffic ticket attorney at Meltzer & Bell, P.A., “The Traffic Stop.”

Speeding Tickets with a Pace Clock in Florida

Florida Statute Section 316.1905 provides certain limitations on an officer issuing a speeding ticket after making a speed determination using a pace clock. These speeding tickets are common throughout Palm Beach County, FL. The rules for permitting this testimony are set out in the Florida Administrative Code in Section 15B-2.009. A presumption of reliability for the pace clock can only be established with the following testimony:

  • The device was approved by the DHSMV and a certificate is required for this showing;
  • The device was tested by a competent retailer or repair facility prior to being put into service and not less than once every six months thereafter; and
  • The certificate is signed and witnessed in a manner that confirms that the inspections were performed properly and that the pace clock was working properly.
