What is the Fine for Speeding in a School Zone in Florida?

Florida law indicates that the maximum a school can set its speed limit to is 20 miles-per-hour. When a person violates that law and speeds at as school’s premises it can result in an extremely costly ticket. In addition, law enforcement officers choose school zones as a prime spot to look for people breaking traffic rules. That means they will be quick to arrest you even if you are hardly speeding over the legal limit.

If you are ticketed for speeding in a speed zone, your fine will be one of the following:

  • 1 – 9 mph over the limit: $50
  • 10 – 14 mph over the limit: $200
  • 19 – 25 mph over the limit: $300
  • 20 – 29 mph over the limit: $350
  • 30 – 29 mph over limit: $500
  • 50 mph or more over the limit: $2,000

It’s important to understand that the fines above are for a first offense only. If this is your second ticket for speeding in a school zone, then you will automatically have at least a $1,000 fine and will be required to appear in court. If it’s your second offense of speeding at or over 50 mph in a school zone, then your fine could be up to $5,000.

How Many Points Are Added to My License for Speeding in a School Zone in FL?

Fines aren’t the only consequence you may face for admitting guilt to speeding in a school zone. Florida automatically adds points to a person’s license if they are convicted of a moving or nonmoving violation. Each offense has a different point value that can be increased based on the circumstances of the citation.

If you have enough points on your license in a given period, then your driver’s license will automatically be suspended by the Department of Highway Safety and Motor Vehicles (DHSMV). In some cases, the suspension can last up to two years. If you are convicted of speeding in a speed zone, the following points will be added to your record:

  • 15 MPH or less over lawful or posted speed – 3 points
  • 16 MPH or more over lawful or posted speed – 4 points
  • Unlawful speed resulting in a crash – 6 points

For some violations, the offender can avoid having points added to their record if they complete certain conditions such as finishing a driver’s course. If this happens you will be asked to present your certificate to the county clerk by the deadline specified on your ticket. Once you do this you will have your points removed on your license.

How Do I Know If I’m Driving Through a School Zone in Florida?

Since school zones are an enhanced penalty zone area the state of Florida has specific signage laws, so the area is easily identifiable. Florida Statute Section 316.1895(6) states the school must erect permanent signs to illustrate that they are a school zone. In. addition, the signs must indicate the speed limit and be the same size and color. It must be easily recognizable by drivers for the area to be considered a legal school zone.

Florida statues also establish that the lowered speed limit for school hours must be posted clearly for all drivers. They can use a flashing beacon or other automatic device that is activated manually as well to show when school zone hours are active. The flashing beacon standards must meet the requirements set by the Florida Department of Transportation. If there isn’t enough indication that you were in a school zone, then your attorney can utilize this information to fight your ticket.
