Why Was My License Suspended or Revoked?

Florida determines suspensions by their driving record. Anytime you violate a traffic law or commit a vehicular offense you accumulate points. Having a certain number of points on your record will result in a suspension. For instance, having 12 points on your record within one year is an automatic 30-day suspension.

Your license could have been suspended or revoked for several reasons, including:

  • Failure to complete a driver improvement course;
  • Failure to comply or appear in a traffic summons;
  • Failure to pay fines;
  • Showing your incapability of operating a vehicle;
  • Traffic violation resulting in the death or serious injury of another person;
  • Owning a fraudulent license;
  • Being delinquent on paying child support; or
  • Driving record point accumulation

How Do I Reinstate My License in Florida?

Every suspended driver has a different list of conditions they must fulfill before they can request DHSMV to reinstate their license. Before making any major decisions, review your suspension notice and confirm what you must do to reinstate your driving privileges.

Some requirements your suspension notice includes is:

  • Pay court and traffic fines;
  • Pay the reinstatement fee;
  • Finish your incarceration;
  • Complete your probation period;
  • Finish all court-ordered community service;
  • Undergo a drug and alcohol evaluation;
  • Take a DMV-approved traffic school; and
  • Take a drug and alcohol course

In some cases, the DHSMV may request you bring specific paperwork as well as pay any associated fees. For instance, those convicted of DUI must bring a copy of their bodily injury liability insurance as well as the affidavit of the crime. Drivers who were suspended due to inadequate vision must bring record of their eye exam showing you meet the minimum vision standards described by the Florida Statutes.

Hardship Licenses in Florida

Planning to reinstate your license is expected, but did you know you could retain some of your driving privileges on a suspended license? In the state of Florida, you can receive a restricted license that only allows you to drive for certain activities known as a hardship license.

Florida offers drivers with a suspended license to request a hearing for a hardship license within 10 days of receiving their suspension notice. It’s known as an administrative review hearing and would be conducted by a hearing officer at the DHSMV. You must submit your request before the due date, or it will be denied with no chance of acceptance in the future.

At the hearing, you can bring legal representation and argue why the suspension isn’t necessary. Having legal counsel will significantly increase your chances of obtaining a hardship license. If you’re successful at the hearing, you will have limited driving privileges such as buying household essentials and going to work.
