Right-on-Red Violations
Under Florida Statute Section, 316.0083, a city or county may not issue a notice of violation and a traffic citation for a right on red violation if the motorist makes the right-hand turn in a “careful and prudent manner.” See Florida Statute 316.0083, (1)(a) and (2), F.S.
The phrase “careful and prudent manner” was not originally defined in the statutory scheme. Most courts interpret the term “careful and prudent manner” for the purpose of issuing a red light camera citation for a right-on-red violation as coming to a complete stop before turning right at those intersections where a right-hand turn is permissible) even if the driver has stopped beyond the stop line.
